Public Offer Agreement for the Provision of Tourist Services
This document is an official offer by Sole Proprietor Kirill Vladimirovich Pantyashin (hereinafter referred to as the "Contractor"), represented by Kirill Vladimirovich Pantyashin, acting on the basis of the Certificate of State Registration of an Individual as a Sole Proprietor No. 344108365713 dated January 15, 2024, addressed to individuals and legal entities to conclude an agreement for the provision of tourist services under the terms outlined below. This agreement is published on the website https://permapark-events.ru.
In accordance with Paragraph 2, Article 437 of the Civil Code of the Russian Federation, this document is a public offer.
Definitions
The following terms are used in this Agreement:

• Tourist, Tourist Product, Tourist Voucher — interpreted as defined in Article 1 of Federal Law No. 132-FZ dated November 24, 1996, “On the Basics of Tourist Activities in the Russian Federation,” as amended.
• Contractor — Sole Proprietor Kirill Vladimirovich Pantyashin, TIN: 344108365713.
• Offer Agreement — an agreement between the Contractor and the Customer for the provision of tourist services, concluded through the acceptance of this offer.
• Acceptance of the Offer — full and unconditional acceptance of the terms of the offer by performing actions by the Customer that express the intention to use the Contractor’s website to order services.
• Website — publicly accessible site available at https://www.permapark.camp/, providing information about the services offered by the Contractor.
• Customer — a user, either a legal or physical person, who has accepted the offer and thus becomes a customer of the Contractor under the concluded offer agreement.
• Order/Application — a properly completed request by the Customer to receive services selected on the website.
• User — a legally capable individual over the age of 18 who has the legal right to enter into contractual relationships with the Contractor.
• Payment System — a company providing electronic payment acceptance services on the website on behalf of the Contractor.
• Payment — funds transferred by the User to the Tour Operator to pay for booked tours.
• Authorization — the process of verifying identification data entered by the User on the Tour Operator’s server to determine their right to receive services or use the user interface.
• Internet Acquiring — accepting card payments online via a specially developed web interface provided by banks or payment systems to process transactions in online stores.

Other terms not defined above may be used in the Agreement. Their interpretation is determined by the context of the Agreement.
Subject of the Agreement
1.1. The subject of this Agreement is the provision by the Contractor to the Customer of tourist and related services under the terms of this Agreement. Tourist services refer to a pre-arranged package of travel services for one-day or multi-day tours within the territory of the Russian Federation.
1.2. Information on the range and content of tourist services is provided on the Contractor’s website at https://www.permapark.camp/
1.3. The terms of this Agreement are accepted by the Customer in full. Evidence of full and unconditional acceptance of the terms of this Agreement is the Customer’s registration on the Contractor's website and payment for the tourist services.
1.4. Unless otherwise provided by this Agreement or arising from the nature of the obligation or the requirements of law, the contractual rights and obligations of the Customer also apply to the tourists on whose behalf this Agreement was concluded.
Rights and Obligations of the Parties2.1. Contractor’s Obligations:
2.1.1. To provide tourist services in full in accordance with the selected tour program. The cost of the tour is determined by the Contractor and published on the website.
2.1.2. To ensure the quality of services provided, in accordance with standards approved by the laws of the Russian Federation.
2.1.3. To inform the Customer about the conditions and contents of the tourist services.
2.1.4. To inform the Customer about the rights and obligations of third parties (organizations) directly involved in service delivery.
2.1.5. In the event of changes in service prices or terms due to reasons beyond the Contractor’s control, to timely inform the Customer.
2.1.6. To timely inform the Customer of any changes to tour conditions resulting from significant changes in circumstances or force majeure.
2.1.7. The Contractor is not liable for failure to fulfill the Agreement in the following cases:

• Force majeure (natural disasters, wars, epidemics, accidents, etc.);
• If services (tour) were not paid on time;
• For additional services not specified in the order or tourist voucher;
• If the Customer independently changes elements of the program (excursions, transfers, accommodation, late arrival, etc.);
• For loss or theft of baggage and personal items.

2.2. Contractor’s Rights:
2.2.1. To cancel a tour application if payment from the Customer is not received.
2.2.2. To unilaterally terminate this Agreement. Termination is effective from the date a notice is sent to the Customer via email.
2.2.3. To enter into contracts with third parties who directly provide services within the tour package.
2.2.4. To cancel a booked tour due to an insufficient number of participants no later than 5 days before the start of the tour, or 2 days in case of weekend tours. In such cases, the Contractor returns the full amount paid or, upon agreement with the Customer, credits it toward another tour.
2.2.5. To refuse services if the Customer:

• Violates public order or causes disturbance;
• Is intoxicated by alcohol or drugs, or violates public conduct rules;
• Is involved in drug possession/distribution, illegal possession of weapons, etc.;
• Has improperly issued personal documents (e.g., missing notarized consent for minors, etc.).

2.3. Customer’s Obligations:
2.3.1. To pay for the booked tour in accordance with prices and terms established by the Contractor.
2.3.2. To review all information about the selected tour on the Contractor’s website: tour program, dates, cost.
2.3.3. To provide true, accurate, and sufficient personal data required to process the tour booking, including valid contact details (phone, email).
2.3.4. To arrive on time at the tour’s departure location. Any delays or missed departures due to traffic or transport issues are the Customer’s responsibility. No-shows are treated as cancellations.
2.3.5. To comply with the rules for passenger and luggage transport as defined by the carrier or legal regulations.
2.3.6. During travel, the Customer must:

• Respect local laws, traditions, customs, and religion;
• Follow environmental and cultural heritage rules;
• Maintain personal safety and health precautions;
• Treat third-party property with care and abide by usage rules;
• Inform the Contractor of any service issues;
• Inform all travelers listed in the tour about the Agreement terms and provided information;
• Guarantee legal authority to represent third parties if booking on their behalf.

2.3.7. To clarify with the Contractor (at least one day before departure) the time, location, and other essential details of the trip.
2.4. Customer’s Rights:
2.4.1. To receive the services paid for in accordance with this Agreement.
2.4.2. To request information from the Contractor regarding tour terms and conditions.
